Terms of Service
These terms govern your purchase and use of BudgetFLEX™, published by FLEXEC Advisory LLC.
1. Agreement
By downloading, installing, or using BudgetFLEX™ (“the app”), you agree to these Terms of Service (“Terms”). If you do not agree, do not install or use the app. FLEXEC Advisory LLC (“FLEXEC”, “we”, “us”) may update these Terms; the effective date above reflects the current version.
2. License grant
Upon purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use BudgetFLEX™ on up to five (5) devices that you own or control. The app is licensed, not sold.
You may not:
- Resell, sublicense, rent, lease, or redistribute the app or your license key.
- Reverse engineer, decompile, or disassemble the app, except where such restriction is prohibited by applicable law.
- Remove or alter any proprietary notices, branding, or trademarks.
- Share your license key publicly or use it to circumvent device limits.
3. Free trial
Direct downloads of BudgetFLEX™ include a time-limited free trial. No payment method is required to start the trial. Purchases made through the Microsoft Store or Mac App Store do not include a trial.
4. Payment and taxes
Purchases made on budgetflex.app are processed by Paddle.com, which acts as the merchant of record and reseller for our software. Paddle handles payment, invoicing, and applicable sales tax or VAT, and your purchase is also subject to Paddle's terms and privacy notice. Purchases made through an app store are governed by that store's terms.
Prices are shown in your local currency where supported and may change at any time; changes do not affect licenses already purchased.
5. Refunds
Refunds are governed by our Refund Policy.
6. Your data
BudgetFLEX™ is local-first: your accounts, transactions, budgets, categories, and reports are stored only on your device and are never transmitted to us, other than the minimum information required to validate a license. You are solely responsible for safeguarding and backing up your data. See our Privacy Policy.
7. Updates and availability
We may release updates, fixes, and new features at our discretion. We do not guarantee that any specific feature, roadmap item, or platform will be released, or that the app will be error-free or uninterrupted.
8. Disclaimer of warranties
BudgetFLEX™ is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The app is a personal budgeting tool and does not provide financial, tax, investment, accounting, or legal advice.
9. Limitation of liability
To the maximum extent permitted by law, FLEXEC Advisory LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or financial outcomes arising from your use of the app. Our total aggregate liability is limited to the amount you paid for your license.
10. Termination
Your license terminates automatically if you breach these Terms. On termination you must stop using the app and remove it from your devices. Your locally stored data remains yours and on your device.
11. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to that jurisdiction and venue.
